dc.description Transitional Justice is touted from a normative perspective in Colombia since 2005. Laws such as 975 of 2005 “Justice and Peace”, 1424 2010 “on the historical contribution agreements for the truth,” 1448 2011 “of victims and land restitution” and Legislative Act 001 of 2012 “legal for Peace “framework have been uttered since then. These laws and norms have had differing perspectives and balances. This document proposes a strategy to find a balance regarding the implementation of these legislative instruments from international standards protecting the rights of victims. It also proposes to develop general proposals for a transitional justice paradigm that departs from the conflict scenario to one of peaceand that unchecks itself from to conflict of pseudodemocracy real and effective democracy. en-US
dc.description Desde el año 2005 se habla normativamente en Colombia de Justicia transicional. Básicamente se han proferido las leyes 975 de 2005 “de justicia y paz”, 1424 de 2010 “sobre los acuerdos de contribución histórica por la verdad”, 1448 de 2011 “de víctimas y restitución de tierras” y el Acto legislativo 001 de 2012 “marco jurídico para la paz”. Cada una de tales normas han tenido perspectivas divergentes y sobre ellas los balances son diversos. Lo que se propone el presente documento es realizar de manera concreta un balance respecto de la implementación de cada una de tales mecanismos legislativos a partir de los estándares internacionales de protección de los derechos de las víctimas; y realizar propuestas generales destinadas a que la justicia transicional abandone el paradigma del escenario de conflicto hacia la paz y se desmarque hacia el conflicto de seudodemocracia a democracia real y efectiva. es-ES
