dc.description The article in question was developed as a product of a project developed as a degree work for the Faculty of Law of the Antonio José de Sucre University Corporation of the city of Sincelejo in the year 2019 in order to carry out a detailed analysis of the legal framework that supports the environmental management plan of the municipality of Coveñas and therefore determine the environmental conditions currently present in this coastal area belonging to a very important sub-region of the department of Sucre such as the Gulf of Morrosquillo and in particular the negative impacts derived from the lack of an adequate environmental culture in the Ciénaga la Caimanera, which considerably affects not only its body of water but the environment itself; For this purpose, the national regulations available for the subject and the plan that is carried out locally in relation to the jurisprudence for this purpose of the Ministry of the Environment will be studied. Framed in the field of Social Sciences, the design of the descriptive Research is proposed, the conclusions of the study contrasted the Environmental Management plans, enunciated under the Development plans of the government of the department of Sucre as a measure to mitigate the risks environmental, reviewing fundamental aspects of Law 99 of 1993, which created the Ministry of the Environment, thus reordering the public sector in charge of the management and conservation of the environment and renewable natural resources, organizing the National Environmental System, SINA , and other decentralized institutes, among which CARSUCRE is found in the case of the department of Sucre. en-US
dc.description El presente artículo es producto de un proyecto de investigación desarrollado como trabajo de grado para la Facultad de Derecho de la Corporación Universitaria Antonio José de Sucre, de la ciudad de Sincelejo, en el año 2019. Su propósito es realizar un análisis detallado del marco jurídico que soporta el plan de gestión ambiental del municipio de Coveñas y, por tanto, determinar las condiciones ambientales que presenta en la actualidad esta zona costera, perteneciente al golfo de Morrosquillo, una subregión muy importante del departamento de Sucre. De esta forma se pueden señalar los impactos negativos que se derivan de la falta de una cultura ambiental adecuada en la ciénaga La Caimanera, que afectan considerablemente no solo al cuerpo de agua, sino al entorno mismo. Se estudiará la normatividad nacional disponible para el tema y el plan que se ejecuta localmente con relación a la jurisprudencia para tal fin del Ministerio del Medio Ambiente. Enmarcada en el campo de las ciencias sociales, la investigación tiene un diseño de orden descriptivo. Las conclusiones de este trabajo contrastan los planes de gestión ambiental, enunciados al amparo de los planes de desarrollo de la Gobernación del departamento de Sucre, como una medida para mitigar los riesgos ambientales. Se revisan aspectos fundamentales de la Ley 99 de 1993, creada por el entonces Ministerio del Medio Ambiente para reordenar el sector público encargado de la gestión y conservación del medio ambiente y los recursos naturales renovables, así como para organizar el Sistema Nacional Ambiental (SINA) y otros institutos descentralizados, entre los que se encuentra, para el caso del departamento, CARSUCRE. es-ES
