dc.description In this article the legal problem proposed –which seeks to determine if the regulation of the environmental and social impact assessments in Colombia provides an effective protection of the indigenous people’s rights, as suggested by the relevant international standard– will be developed. In order to do so, we will study the international standards proposed by the different agencies in connection with the obligations that must be complied with to respect the indigenous people’s rights to know and participate in the environmental and social impact assessments. Subsequently, we will present two important points of view: the first explains the Colombian regulations on the subject; the second one shows general and specific situations where the reality of the indigenous people in Colombia is analyzed in relation with the application of the environmental and social impact assessments. en-US
dc.description En el presente artículo se desarrollará el problema jurídico planteado, que busca determinar si la regulación de los estudios de impacto socioambiental en Colombia otorgan una protección efectiva a los derechos de los pueblos indígenas tal como lo sugiere el estándar internacional pertinente. Para ello, se estudiarán los parámetros internacionales establecidos por los diferentes estamentos con relación a las obligaciones que deben cumplirse para respetar el derecho de los pueblos indígenas de conocer y participar en los EISA. Posteriormente se plantearán dos momentos importantes, el primero consiste en explicar la normativa colombiana sobre el tema; el segundo, va dirigido a exponer situaciones generales y específicas donde se analiza la realidad que viven los pueblos indígenas en Colombia frente a la aplicación de los EISA. es-ES
